Need some help/advice on PERM LC issue:
My employer has filed PERM LC (PD Sep 2008) in EB2 (Job Description: Masters OR Bachelors with 5 Yrs experience),
On may'09 got a query saying "Discrepency in Alien education and experience".
Stating: Alien workerer possessed Masters Degree and 16 months of experience where as the minimum job requirements set ETA form (H8 and H10)specified Masters and 5 yrs of experice.
my employer appealed saying: " H.4 in ETA does indicate masters deg. is the minimum requirement for the position and there is however no mention made of 5 yrs of exp. this appears in 8.A and 8.C as an alternate education and experience and therefore not related to the minimum requiremnt for the position"

UPDATE : After the appeal sent by my employer, my PERM case shows status as "in-process". Does it mean it will fall under usual processing times ? Can I expect a response in the coming months ? Please let me know.

Unless it is an expired "conditional status" card, your legal status in the US in no way changes. Only the card expires and not your legal LPR status! I don't quite understand what your "mistake on birthday" comment is all about!
You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.

Did you declare your arrest record at the time of I-485 filing and did INS respond to that? What stage of I-485 filinga are you? Do you already have your AP?
As far as I know you can be denied entry IF your I-484 is denied while you are out of the country.

Lost I20.
Went to school from 96 to 2000.
WOrking on H-1 since then.
Numerous trips outside. Last one in 2005 on an H-1 visa.
What do I do now?
That should not be any problem at all. I called my school's International office and they got my I20 from 99 scanned it and emailed it to me. I got it within half a day of making the call.

I got the email today, per email card production ordered on April 12th 2008.
Filing dates as follows:
485 filing date July 27 2007:
485 Notice date Sept 26 2007
I140 with LC SUB EB-2 with PD July/2001 approved on Jan 2008

First, your international student adviser, should have notified you that your I-20 was about to expire. This is what USCIS requires them to do. Actually the SEVIS system automatically notifies IS advisers about I-20 expiring. Now, having said that, no, you cannot work. You need to apply for reinstatement and wait until it gets approved. Reinstatement into F-1 are very difficult as you need to show that you fell out of status because of circumstances beyond your control. You will probably need to argue that your adviser had failed to notify you and that you kept attending school and it was only a few days of out of status.

My Father is applying for Citizenship in Nov 10. If he becomes Citizen then can I file I485 under F3(married sons and daughters of citizen parents). Category and port priority date of May 03 from my employment base I-485 to I-485 under F3?

The guy in the boxing stance is an aspiring film producer who saw a photo of Jet Li done by Jeff Dunas where everything but the leading fist was in focus and wanted something similar. I like it because it's different.
The guy crouching....his face is out of focus no photoshop involved, that was my mistake. Unfortunately, I have to go with lighting and posing aspects to hopefully override the focus issue as I'm out of time.
No comments on the guitar shot? I'm just going to go with a "no news is good news" attitude on that one. :)
Truth be told, I've had a lot of problems with this portrait class. I've never really done formal portraits (nevermind worked in a full-blown studio environment) before so I had (and still have) a lot to learn.
